 Service & Hold Harmless Agreement 

LOCATION 

CrossRoads Dog Academy and the trainer(s) will take all reasonable steps to keep the dog safe, comfortable, appropriately exercised, and happy while the dog is in our care. I acknowledge by signing this contract, as the dog owner, I am responsible for my dog’s actions in a public setting if my dog is injured, injures another animal, or injures another person. Crossroad Dog Academy highly recommends having your dog wear a training vest with information corresponding to the dogs behavior at all times while in public, during private consultations or private lessons. While Crossroad Dog Academy is handling the dog in public they will wear in training vest with information corresponding to the dogs behavior at all times to notify the public around them. ​

 

NO SHOW, CANCELLATION & REFUND POLICY​

• In the event of severe weather and we must reschedule you will be eligible for a refund if you cannot attend the rescheduled date.

• I acknowledge that if I am a “no show” to a scheduled appointment that I will not receive a refund of any kind.

• I acknowledge that I will NOT receive any refund for canceling or rescheduling 1 week before service or booking start date.​​​

• I acknowledge that I will ONLY receive a 50% refund credited to my account for canceling or rescheduling 2 weeks before service or booking start date.​

 

PHOTO VIDEO & SOCIAL MEDIA RELEASE

I acknowledge, hereby grant permission to CrossRoads Dog Academy to use my likeness, my dog or my property in photographs, videos, and social media content. I understand that my image may be used in promotional materials, websites, social media platforms, and other marketing materials. I also acknowledge that my name may be used in connection with the images and videos. I understand that these materials may be used for an unlimited period of time and that I will not receive any compensation for their use. I hereby release, discharge, and hold harmless to Crossroads Dog Academy, employees, members of the officers, and/or agents from any liability arising from the use of my likeness in the aforementioned materials. I understand that my participation is voluntary and that I have the right to revoke this permission at any time.

 

ACTIVITIES COVERED

THIS AGREEMENT APPLIES TO ANY ACTIVITY HOSTED OR SUPPORTED BY CROSSROADS DOG ACADEMY, INCLUDING, BUT NOT LIMITED TO PRACTICES, TRAINING SESSIONS, COMPETITIONS, WORKSHOPS, DEMOS AND SOCIAL ACTIVITIES (AN “ACTIVITY”).

 

UNDERSTANDING OF RISK

I UNDERSTAND THAT PARTICIPATION IN AN ACTIVITY IS NOT WITHOUT INHERENT RISKS DUE TO THE PHYSICAL NATURE OF DOG TRAINING AND SPORTS AND BECAUSE ANY DOG HAS THE ABILITY TO CAUSE INJURY. I ALSO UNDERSTAND THAT BRINGING DOGS TOGETHER CAN LEAD TO TRANSMISSION OF CERTAIN DISEASES AMONG DOGS, AND I TAKE FULL RESPONSIBILITY FOR PROTECTING AND/OR TREATING MY DOG FOR ANY DISEASE(S) TO WHICH MY DOG MAY BE EXPOSED WHILE PARTICIPATING IN AN ACTIVITY. I ACKNOWLEDGE FULL RESPONSIBILITY FOR ANY DOG I BRING TO AN ACTIVITY.

CERTIFICATIONS

I CERTIFY THAT I AND ANY DOG I BRING TO AN ACTIVITY ARE IN GOOD HEALTH AND CAPABLE OF PARTICIPATING SAFELY IN THE ACTIVITY. I ALSO CERTIFY THAT ANY DOG I BRING TO AN ACTIVITY IS CURRENT ON ANY  LEGALLY REQUIRED VACCINATIONS.

 

Disclaimer

CUSTOMER ACKNOWLEDGES THAT ALL SERVICES PROVIDED BY CROSSROADS DOG ACADEMY ARE PROVIDED “AS IS” AND “WHERE IS” WITHOUT ANY WARRANTY WHATSOEVER AND THAT CUSTOMER’S USE OF THE SERVICES IS AT CUSTOMER’S OWN RISK. NEITHER CROSSROADS DOG ACADMY, ITS MEMBERS, OFFICERS, EMPLOYEES AND AGENTS, MAKE ANY WARRANTIES, EXPRESS, IMPLIED OR OTHERWISE WITH RESPECT TO THE RESULTS OF THE SERVICES AND CROSSROADS DOG ACADEMY CANNOT PROMISE THE SKILL LEVEL WHICH MAY BE OBTAINED BY CUSTOMER’S PET. CROSSROAD DOG ACADEMY AND ITS MEMBERS, OFFICERS, EMPLOYEES AND AGENTS EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND/ OR NON-INFRINGEMENT. 

 

Liability Release

 IN CONSIDERATION OF BEING ALLOWED TO PARTICIPATE IN THE SERVICES, CUSTOMER MUST AGREE TO THE PROVISION OF THIS SECTION AND CUSTOMER AGREES THAT CROSSROADS DOG ACADEMY WOULD NOT PROVIDE THE SERVICES WITHOUT THE RELEASE IN THIS SECTION. CUSTOMER IS AWARE THAT THERE IS A RISK OF INJURY TO THE CUSTOMER AND THE DOG WHEN PARTICIPATING IN ANY OF SERVICES WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO, BRUISES, CUTS, SCRAPES, BROKEN BONES AND EVEN MORE SERIOUS INJURIES WHICH MAY LEAD TO DEATH. CUSTOMER KNOWINGLY ACCEPTS THESE RISKS, WHETHER KNOWN OR UNKNOWN, ON BEHALF OF CUSTOMER AND ON BEHALF OF CUSTOMER’S DOG, INCLUDING THE RISKS THAT MAY ARISE FROM A PET HANDLER’S NEGLIGENCE. CUSTOMER AND CUSTOMER’S HEIRS AND ASSIGNS, HEREBY RELEASE AND HOLD HARMLESS CROSSROADS DOG ACADEMY, ITS MEMBERS, OFFICERS, EMPLOYEES AND AGENTS, AND ANY OTHER PEOPLE OFFICIALLY CONNECTED WITH CROSSROADS DOG ACADEMY FROM ANY AND ALL LIABILITY FOR DAMAGE DUE TO OR LOSS OF PERSONAL PROPERTY, INJURY FROM WHATEVER SOURCE, OR DEATH WHICH MIGHT OCCUR TO CUSTOMER OR CUSTOMER’S DOG OR WARD WHILE PARTICIPATING IN THE SERVICES. CUSTOMER AGREES THAT CUSTOMER WILL BE RESPONSIBLE FOR ANY AND ALL MEDICAL COSTS CUSTOMER OR CUSTOMER’S DOG OR WARD INCURS AS A RESULT OF PARTICIPATION IN THE SERVICES. CUSTOMER FURTHER AGREES TO REIMBURSE CROSSROADS DOG ACADEMY, ITS MEMBERS, OFFICERS, EMPLOYEES AND AGENTS FOR ANY LEGAL FEES, INCLUDING COURT COSTS, THAT THEY MAY INCUR IN THE DEFENSE OF ANY CLAIM, CAUSE OR ACTION, OR DEMAND WAIVED UNDER THIS SECTION.
